US Supreme Court: Gun Licensing Fees Are Unconstitutional

The executive summary of the ruling in Murdock v. Pennsylvania (1943) was that it is unconstitutional for a state to levy a tax on people who want to sell religious merchandise.  “A municipal ordinance which, as construed and applied, requires religious colporteurs to pay a license tax as a condition to the pursuit of their activities, is invalid under the Federal Constitution as a denial of freedom of speech, press and religion. The mere fact that the religious literature is ‘sold’, rather than ‘donated’ does not transform the activities of the colporteur into a commercial enterprise.”

What does this have to do with fees to obtain a license to own or purchase a firearm?  The USSC also found, “A State may not impose a charge for the enjoyment of a right granted by the Federal Constitution.”  This means the entire Bill of Rights as opposed to just the First Amendment.

“Biden-Harris Administration Announces Initial Actions to Address the Gun Violence Public Health Epidemic,” a “fact sheet,” released on April 7, cites an “historic spike in homicides, violence that disproportionately impacts Black and brown Americans.” Five times the statement decries “gun violence,” a formulation notably absent from pronouncements by Joe Biden when he was vice president to the composite character David Garrow described in Rising Star: The Making of Barack Obama.

In a speech at the White House on Thursday, Joe Biden announced further executive actions on the subject of gun control, saying, “Enough prayers, time for some action.” During the event, Biden parroted the false “gun show loophole” claim which is routinely promoted by gun control advocates. But over at the NY Times, there’s an interesting op-ed by a former president of the Brady Campaign to Prevent Gun Violence. What’s surprising about it is that author Dan Gross admits the usual left-wing rush toward things like the assault weapons ban after every high-profile mass shooting makes no sense if your real goal is to reduce the bulk of gun violence.

Biden Gun Speech Filled With Falsehoods

President Joe Biden made numerous false and misleading statements while unveiling a package of gun-control actions on Thursday.

Biden falsely described how federal firearm laws work as he called for Congress to amend those laws. He pushed the Senate to pass H.R. 8, which would ban private gun sales unless done through a licensed dealer, by claiming there is a special exemption for sales made at gun shows.

“Most people don’t know, you walk into a store and you buy a gun you have a background check,” Biden said in his speech at the White House. “But you go to a gun show, you can buy whatever you want and no background check.”

Biden Administration Announces Plans to Curb ‘Ghost Guns,’ Push ‘Red Flag’ Legislation

President Joe Biden’s administration is taking action to stop the proliferation of so-called ghost guns and push states to adopt “red flag” legislation, the White House announced late Wednesday.

Biden is directing the Department of Justice to, within 30 days, issue a proposed rule aimed at curbing the spread of so-called ghost guns, or guns that are made from build-it-yourself kits.


Biden could turn 3M to 4M gun owners into felons

President Biden’s abrupt move to regulate one of America’s most popular firearms for plinkers and hunters could turn up to four million owners into felons overnight.

Among the six initiatives he is taking in executive actions, Biden is ordering the Justice Department to regulate AR-15-style pistols, the current rage with buyers.

While they can currently be purchased like longer rifle versions after an FBI background check, AR pistols could soon be subject to a $200 tax and require approval by the Bureau of Alcohol, Tobacco, Firearms and Explosives, a process that already takes nearly a year.

“In times of uncertainty people want to be able to have the means to defend themselves,” a law professor said.

Black people are buying guns at a high record rate, partially due to fear and anxiety, according to The Guardian.

Black people owning guns have gone up 58.2 percent, according to the National Shooting Sports Foundation (NSSF) — and gun groups like the “Not F**king Around Coalition (NFAC)” consist of armed social justice advocates who demand justice for George Floyd and Breonna Taylor, visibly strapped with handguns.

Iowa Governor Signs Bill Into Law Letting Residents Buy, Carry Guns Without Permits

Iowa Gov. Kim Reynolds signed legislation into law on Friday lifting some restrictions to buy or carry a handgun in the state for law-abiding citizens.

The NRA-backed legislation named “House File 756” will take effect on July 1 and eliminates the requirement for law-abiding Iowans to obtain a permit to purchase a handgun from private non-licensed sources. Additionally, to carry a weapon, people will no longer need to have a permit as well.

On Tuesday’s Amanpour & Co., the PBS show not only did its part to spread anti-gun misinformation, but also to demonize Republicans who dispute the value of more gun control. Host Christiane Amanpour and her guests made several blatantly false claims about the significance of background checks and the prevalence of so-called “assault weapons.” She also allowed one of her guests to sneer that Republicans “don’t have a conscience” when it comes to guns.

On Wednesday afternoon, MSNBC host Katy Tur used her show to to misinform viewers about gun violence while wrongly accusing gun rights advocates of spreading “lies.”

After alluding to some of the gun control laws that have been passed in Colorado in the past decade, Tur allowed Colorado Democratic State Senator Rhonda Fields to complain that her state’s residents could still get guns from Wyoming or Utah without offering any evidence that this has happened in any recent shooting.

White House press secretary Jen Psaki confirmed Friday that President Joe Biden intends to sign executive orders instituting increased gun control.

“Yes,” Psaki flatly stated in response to a question on the subject during Friday’s press briefing. “I can’t give you an exact time frame in part, because they have to go through a review process, which is something that we do from here.”

US Appeals Court Rules States May Restrict People From Openly Carrying Guns in Public

An appeals court on Wednesday ruled that states may restrict people from openly carrying firearms in public—upholding a Hawaii gun regulation that bans residents from openly carrying guns without a license.

The U.S. 9th Circuit Court of Appeals ruled 7-4 that restrictions on carrying guns in public except for hunting do not violate the Second Amendment’s right to bear arms.
