California Lawmakers Want Knowingly Giving Someone HIV To Be A Misdemeanor, Not Felony

Charging people with a felony for knowing giving sexual partners HIV without disclosing their infection is “homophobic” and “discriminatory” against LGBT people, according to California state lawmakers.

    Oh oh. California state lawmakers lay themselves open to law suits. The mere suggestion that gay men are a high risk group for reckless transmission of HIV will be declared “homophobic” and “discriminatory”.

      In 2014 the Court of Appeal of England & Wales upheld a conviction over non-disclosure of genital herpes. The 2011 conviction was that David Golding was guilty of reckless grievous bodily harm under Section 20 of the Offences Against The Person Act 1861. However, the sentence was reduced from 14 months to 3 months and as he’d served 6 weeks on remand in 2011 he didn’t go to prison.

    Is there not a federal law that criminalises it? If so, that takes precedence over state law from my understanding.
