Australia: Women disadvantaged as Sharia law used to settle divorces in Muslim community

Muslim communities in Australia have been quietly practising sharia law in negotiating divorces, disadvantaging women in custody and property arrangements.

The Muslim communities then have been turning to the Family Court to authorise the heavily weighted “agreements’’, which often provide “guardianship” of school-aged children to men and incorporate the return of any marriage dowry as well as other financial compensation from the women.

The “guardianship” principle under sharia law means the parent can make all the significant decisions about a child, irrespective of who has custody.

The Australian has learned that Muslim women agree to the sharia agreements so that they can then initiate a religious ­divorce before Islamic imams, and avoid being stuck in a restrictive “limping marriage’’.

    I never really have an issue with this. Apart from their medieval religion, there is nothing forcing these women to have a Sharia tribunal. While in Australia, they’ve themselves chosen to be second class citizens. They are more than free to go to a real court.

    • Just as the husband will take the kids and she may never see them again.

      The point is that there is no place for a ‘Shariah’ court in a modern country. There should be no recognition of any ‘decision’ produced by such a court, and if any decision from a ‘shariah’ court is counter to the regular law of the land, the members of the ‘shariah’ court should be punished as law-breakers.

      … or legislate that ‘shariah’ courts be governed and supervised IAW Jewish religious laws.
