VICE Media to fight Mounties’ demand for notes on suspected ISIS fighter

OTTAWA–Canada’s national police force is demanding VICE Canada turn over “all notes and communications” between the journalism outlet and a suspected Islamic State fighter, the outlet reported Friday.

The RCMP served VICE with a production order in February to turn over reporter Ben Makuch’s notes and instant message chats with Farah Mohamed Shirdon, a Calgary-born man turned Islamic State militant.

VICE Canada’s head of content, Patrick McGuire, said they intend to fight the Mounties’ demands in court.

    The RCMP can secure a warrant. The RCMP has no place making “demands.”
    Uf there are no grounds for a warrant, well then, the RCMP can suck it up.

      A “Production Order” is issued by a judge with very similar requirements to a warrant. The main difference is the warrant allows the police to enter and seize the information; in the Order the person served with it must provide the info, but the police can’t just enter and take it.

      Generally courts in Canada issue an Order if the recipient is not part of the investigation AND the courts feel the person getting the Order likely has other info in their possession that would be considered confidential and it would be wrong to allow the police to access data because they may access data out side the narrow scope of the order.

      The main examples of them being used are to banks, were the police want financial info on a specific account # but the bank is not suspected of any wrong doing and the judge doesn’t want the RCMP to have the right to search the banks records looking for the account in question because that would give them access to account info outside the scope of the investigation. Another example is giving them to a lawyer to get info on a single client or to a telecom provider to access 1 clients files.

      So in this case the courts are limitting what info the RCMP can access.

          Reading the difference I’m glad the judge didn’t just give a warrant, but i am concerned about the rcmp going after media but i also realize just how much of our media would gladdly help terrorists.

          If there is any evidence that VICE is holding back crucial info, the RCMP can secure a warrant.
          The same RCMP who confiscated passports and then told the public they didn’t have enough resources to surveille the folks whose passports they confiscated. In other words, they wouldn’t let them leave, and let them run loose in Canada, with predictable results.

            It’s Islam that’s at war with the west. So far, the western leaders have been promoting Islamic takeovers and importing Islamic fighters into the west, and western legal systems have been fining/imprisoning people for speaking out about Islam.
            Also, I don’t seem to remember a declaration of war made by anyone in the west.
            Are you saying it should be illegal for journalists to talk to the enemy?

      They’re overwhelmingly left, yes. But in terms of good or bad guys, based on their coverage, I’d put them as all-over-the-map guys, which is miles ahead of MSM (which they’re fast becoming..). Th war zone coverage stands on its own merit. Watch for yourself at

    Tough call, but I would err on the side of Vice.

    If sources are easily divulged, they will dry up.

    I say that without knowing if VICE is a Jihad/Liberal operation or not.
