Court tells Facebook France has jurisdiction in vagina row

A Paris court ruled Thursday that it has jurisdiction to judge a case against Facebook, which blocked the account of a French teacher who posted an image of a vagina by 19th century artist Gustave Courbet.

The court ruled that Facebook’s clause that forces all users to agree that any litigation must be based in California, where the site is based, was “abusive.”

Facebook is being sued by a French father-of-three whose account was suspended after he posted a photo of a painting by 19th century picture by Gustave Courbet, “The Origin of the World”, depicting a naked woman’s vagina.

      best they not understand these things. not having a vagina myself, and having seen a pregnant woman and being told babies come from mothers, I thought a baby must came out a woman’s butt.
      if a had a son who might see that pic, my biggest concern would be that, that might turn him gay. European grooming habits are bad enough today, butt to see the 1800s come to life is not my cup of tea.

      I’m not offended int the least. I just wonder why someone would post this in Facebook. Then again, I am not on Facebook, Twitter, Instagram or any other social media. I saw THAT disaster coming down the pike the moment I heard about it (partly due to my educational/professional specialty).

    Power to the people. I like this judge. This story is not about vaginas. It is about the courts recognizing the unequal position power of the global corporation versus an individual client and the abusive demands vis a vis jurisdiction by the corporation.

      Actually if he doesn’t want to follow facebooks rules he can take his business somewhere else. The fact that the judge decided to rule that a contract was abusive is crap; it’s pretty standard to lay out in the terms of service which jurisdiction will hear all cases otherwise people shop around for a jurisdiction that will give them a special ruling.

        If there is an entity registered as “Facebook France”, it is unlikely that it would be permitted to claim California’s jurisdiction.

      Yes. I recall porn images from The Bush Era. This one is from the same tribe. The introduction of the really small two-piece bathing suit was an aesthetic/erotic godsend, frankly, Ditto the Speedo. I keep the front lawn trimmed as well.

    Is it’s being “19 century” a valid excuse to change it from porn to art? It was porn in “19 century” pre photo technology days, in fact the only porn available was writing, painting and drawings.

    And the painting as “art” as in ” “The Origin of the World” title is bullshit, it’s
    only half of that needed to produce anything but piss

    Typical “artist” using “shock” to sell his wares, and some artsy twerp calling porn
    art as an excuse to display it, and an excuse to shake down facebook via a
    french lawsuit, abetted by the French courts. The same courts who hide out
    preverts like Polanski

    Frankly facebook should just close France for a while and post some art of it’s
    on it’s downtime maintenance screen.
