Restaraunt Mugged By Muslims & The Ontario Human Rights Tribunal

TORONTO – For a small business, it’s hard to fight back when you’ve been tagged as racist by Ontario’s human rights tribunal.

The owners of Le Papillon Park restaurant are devastated by a human rights system they feel unfairly tarred them as bigots and ordered them to pay $100,000 in compensation to three Muslim workers who said they were ordered to eat pork and threatened with replacement by “white” staff.

Paul and Danielle Bigue went to the Divisional Court to request a judicial review of the December 2013 ruling by the Human Rights Tribunal of Ontario, arguing the hearing was unfair and biased against them.

    Justice Douglas Grey et al imagine they do the society a great benefit, dousing the animal passions of coarse citizens who can’t find the light without their special judicial guidance.
    The actual result will be higher unemployment of Muslims. People aren’t stupid, and high risk hires will be avoided.

      I have two friends who run their own small businesses and they are very particular about who they hire. No minorities, and no women breeding age. They’ve both been burned in the past too many times.

    I am constantly amazed at how little the average person knows about these different commissions and tribunals, and how easily they can ruin your life. I wish I knew more about the evidence in this case, because from the allegations described I can’t see how any of that could possibly be proven, it would all come down to a he said/she said type scenario.

      The kangaroo court accepted as “evidence” unsubstantiated allegations. The Muslim’s alleged one thing and the restaurant owner denied the allegations.

      Lesson learned. Don’t ever hire a muslim.

      At our office they hired a muslim once. She was always more concerned about not eating bacon at any staff function than about actually working.

    Sorry, there was no serious reason for the Court to overturn the Commission’s decision. (Whether there should be a Commission at all is a political question.)

    But there is an interesting question here. At one level it is illegal to discriminate against Muslims when hiring – again, whether this should be so is a political question – but would it be illegal to require a chef to pass a cooking test in which pork was cooked? Chefs and cooks have to taste the food they cook. All the food. It is a key element of the job. Soooo…

    There are ways to win these sorts of arguments but they usually begin way before anyone thinks there will actually be an argument.

      It’s illegal to “openly” discriminate against hiring Muslims (for reasons I cannot fathom) but nobody said “you have to have Muslims/whatever on staff”. Just don’t hire them and, when asked, say “position was filled by another candidate.”

        But they can still complain. As a police officer described it once, you can beat the charge but you can’t beat the ride. Meaning it’s the whole process that’s the punishment, not the actual final court decision.

          I wish I could find where it was said last night or remember the site. Just don’t play along or recognize their alleged authority. Say no, don’t show up to court, don’t pay the fines, don’t present evidence. Playing along with them only provokes them. And when they take stuff away from you, make them pay you for it: welfare, etc.

    Bwahahahahahah! A snooty restaurant in Toronto (where only the “elite” are allowed to dine) gets charged by the Human Rights Tribunal….You know the “elite” those with only the proper credentials, say the right things, are seen with the “right” people and think only the “right” things.

          Historically, the HRCs were born at around the time PET (late 60s) came to power. People thought they were a good idea to prevent discrimination in housing and employment.

    Any single Muslim (or gay or odd ball nut X Y or Z) has the power to bring a single action that can devastate any lone business owner, and family dependant upon the same for sustaining their life.

    Any restauranteur who would employ a muslim chef and muslim kitchen help in a non halal operation really needs to revisit and modify his decision making flowchart. Even if they started out as westernized, secularized, ham loving, hard workers, the next wild and crazy imam to hit town could instantly change all that if allah wills it.

      Precisely. A great rationale for not hiring muslims in a non-halal, pork-and-bacon cooking, alcohol-serving environment. As if one needed to explain.

      But I wish these restaurants would start insisting that waitstaff with facial piercings remove them while on shift. They make me queasy, and my wife refuses to eat anything served by someone with a facial piercing. I could live without looking at tattoos, too. They look grimy. But maybe that’s us. We are very conservative at that level. Raised our kids to see “body modification” such as piercings and tattoos as “body mutilation”. It worked. Not a piercing or tattoo among them or their spouses! 😉

    Zero sympathy for the restaurant owners. They hired the muslim bastards and they deserve the consequences. Unless they’ve been living under o rock or in a cave for the last 15 years, they should have known better.

    Let this be a lesson to people capable of using common sense.

    Well, more and more employers will just find excuses for not hiring Muslims. Why even take the risk when so many other potential employees from different religious/cultural backgrounds are available?

    I sure hope that Kathleen Wynne who was talking about quotas for corporate Boards of Directors during the election finally does this.

    If she does I know the next thing we will lobby for will be to bring back Employment Equity so all employers will have to meet quotas, but this time it shouldn’t just be by race and sex like the NDP had but by religion to put an end to all the Islamophobia that is rampant in Ontario. Then you will have to hire only us to get to your quotas!

    the person at the desk said …
    don’t bother they won’t help you because you are white
    I had a bullying boss and I was being told to come in from 9am to 11pm to work and therefore not allowed to go vote in the municipal election!
    I also got NO HELP FROM ELLECTIONS ONTARIO, Ministry of Labour, etc
