Chaotic fatal brawl and shooting at a Walmart caught on dashcam

COTTONWOOD, AZ (KPHO/KTVK) – Video from the dashboard camera of a Cottonwood Police Department cruiser showed a close-knit Idaho family that appeared nearly invulnerable to stun guns, police batons and fists during a melee in a Walmart parking lot March 21 in which one person was killed and one officer wounded by a gunshot.

Cottonwood Police Chief Jody Fanning showed the video during a news conference Friday morning and said no matter what tactics officers used, nothing appeared to deter the family of eight. The dash-cam was the only one of three that was operational that night, Fanning said.

Four officers arrived at the Walmart after employees called about one of the Boise, ID, family members pushing an employee to the ground outside one of the store’s bathrooms.

The family had gathered outside their older model Chevrolet Suburban when officers arrived. The confrontation started when one of the officers said they would split up the family to talk with them about what happened inside the store, Fanning said.

But the father, 55-year-old Peter Gaver, and one of his sons stepped in and told police they wouldn’t allow them to separate the family, Fanning said. Another officer approached the mother, 52-year-old Ruth Gaver, and her 11-year-old daughter when one of the brothers ran in between them.

Police Sgt. Jeremy Daniels grabbed the man and the melee was on, Fanning said.

Fairly obvioius who the aggressors were … imo , not lawful in the US. Any self-respecting Judge would acknowledge that the smalltown police were acting outside of the US Constitution.

Arrests and Other Detentions.—That the Fourth Amendment was intended to protect against arbitrary arrests as well as against unreasonable searches was early assumed by Chief Justice Marshall and is now established law. At common law, warrantless arrests of persons who had committed a breach of the peace or a felony were permitted,58 and this history is reflected in the fact that the Fourth Amendment is satisfied if the arrest is made in a public place on probable cause, regardless of whether a warrant has been obtained.59 However, in order to effectuate an arrest in the home, absent consent or exigent circumstances, police officers must have a warrant.
Pretty sure consent was not given …

So in the state of Arizona, an interview with a law enforcement officer to determine circumstances is the same as an arrest?

      • Stronger than Dirt

        ummm , no, as mentioned.

    • luna

The situation could have been better resolved with dialogue and more officers. Unfortunately one of the officers made a miscalculation and attempted to pin down an individual. That officer deserves some additional training in how to de-escalate a tense situation.

One of the group assaulted a Walmart employee.
      Game over, man!
It’s pat-downs, and FI cards for everyone at that midnight hoedown.

At that point they have the right to detain and interview evryone in the group for more information.
Obviously that bunch was up to no good.
Normal people, even when drunk, don’t act anything close to that.
Once more, I commend the cops’ restraint.

    • Gettingby

I see totally belligerent a-holes who have absolutely no respect for authority, refused to comply with lawful commands, and who in the end got off with less of a shit kicking than they deserved. Hopefully a good judge will make life a bit more unpleasant for them.

    • Gaian

There was no constitutional infringement here, pinhead. There was an assault investigation being conducted on a group of people who were trespassing in a parking lot. The group attacked and wounded a cop, and they endangered a child with their actions. They endangered the public. The cops did their job and I thank them for it.

      • Stronger than Dirt

        I guess you’re right again … bootlicker.

  • Yusuf_Al_Kafir

Based on the video and the article, I’m only left wondering which militia this cuckoo family belonged to.

    • Ed Ellison

I hear they brew some pretty good moonshine up in the hills of Idaho.
      I definitely hear banjos.

      • Stronger than Dirt

They luv their taters in Idaho.

    • Justin

Good family protecting themselves from stupid intrusive and murderous ‘police’ gangs.

      • Justin St.Denis

        Check your head.

      • Gaian

Who are you kidding? These were low-life cretins living in their car in a Wal Mart parking lot. They had a little kid with them (you can see the child in the video). They attacked a Wal Mart employee in a store that had already put up with their crap of hanging out in the parking lot and annoying customers. One of these creeps attacked a cop, tried to get the cop’s gun and ended up shooting the cop. He got himself justly shot as did the creep who attacked another cop. I am 100% behind the cops on this one, and a I really wish that Wal Mart would start heaving everyone out of their parking lots when the store isn’t open.

Militia? Liberals, not making common sense comments since forever.

  • Drunk_by_Noon

I always thought the best way to de-escalate a tense situation with the police was not to create a tense situation with the police.
Whatever happened to “comply with all officer instructions”?

When you do those two simple things you radically reduce the odds of your own arrest (always a win in my book) or things going so sideways that somebody gets shot.

    • eMan14

      Totally agree.

      • Drunk_by_Noon

Any idiot can get arrested, but sometimes it takes some real considered thought to NOT get arrested, and NOT getting arrested is where it’s at.

      • Drunk_by_Noon

        In a way, yes.
That was an odd encounter that I never saw before, so thanks!

Although watching Ralph Nader getting pummeled by the Massachusetts State Police would have been gratifying, and the host of the debate does have a right to limit it to two major party candidates if they wish, I’m glad it didn’t come to that.
I should be more thankful to old Ralph as he siphoned just enough votes away from Gore to tip the balance into GWB’s favor in Florida.
The left has never forgiven him and 2000 was his high water mark.

        • dance…dancetotheradio

Ross Perot did the same thing to Old Read My Lips.
By the way, why is Jeb getting so much traction?

          • Justin St.Denis

Saudi money, probably. Just like Shrillery.

  • eMan14

What happened to the downed cop? Was he stabbed or bitten?

    • Yusuf_Al_Kafir

‘Two of the suspects, including Enoch Graver, battled the officer for his gun, which went off and wounded him in the leg.’

The full article is posted at the link.

This family knows how to fight.

The two brothers fighting each other at the one minute mark are throwing and landing some pretty crisp punches.

      • eMan14

Yeah, found the link after. Thanks.

      • edlancey

I think the big bloke in the grey tee-shirt is actually the Walmart employee judging by his position at the start and the way the police let him wander about.

He definitely gave the big oaf in khaki a few good thumps.

  • BillyHW

Shoot them all and let their god sort it out.

  • lolwut?

Should have called the “Green Bastard”

  • Drunk_by_Noon

Yeah, something was up with this “family”.
Not really people you want as neighbors, which would suck that you are living in the parking lot of a Wal-Mart, and then these a-holes move in, one parking space over.

  • Stronger than Dirt

Only one of 3 dashcams working … I call bs. I think the other dashcams would show the officers assaulting the travellers , who , I might add , made no attempt to flee. Officers went right to force, why ?

  • Rosenmops

In any case, no matter what happened, since everyone appears to be white this story won’t get much traction in the press.

  • Borat

I can hit a gypsy with a rock from 15 meters away if chained… 10 if not.

I say this because, I had a very bad Gypsy attack… they stole my wife, plow… and they touch my horse in a very bad way… he got very depressed.

    • Justin St.Denis

I feel for you. Heart thumping beeg time like drum played by Japanese dood in diaper. How is your houri seester, Borat? Make many babies? With many poppas?

  • Justin St.Denis

Wow! This family is characterized by belligerence. The police had reason to apprehend them. The family didn’t cooperate but, rather, responded like a belligerent gang. Sorry, they get no sympathy from me. I admire the restraint the police demonstrated under the circumstances.

  • Uncle_Waspy

Crazy. Everybody in Ste Saint Marie, ON is like this.
